headings -- numbered vs bare

The wording at http://www.w3.org/TR/xhtml2/mod-structural.html#sec_8.5 .
suggests that <section> iff <h>, but I do not see this in the content
models.

Is there anything but good taste to prevent

<body>
<div><h>bare h in div, not with a section</h>
  <section>
    <section>
      <section><h1>H1, way down deep, and in a section to boot</h1>
</section></section></section></div></body>
