Vulgo the user agent uses its traditional HTML tag-soup parser rather than
the XML parser required to handle xml-stylesheet PIs.

Huh? In some environment maybe, but that's certainly not an universal rule.
Furthermore the "correctest" MIME type for XHTML documents is
application/xhtml+xml.
